Welcome to Party Destination Grid.
These Terms of Service (“Terms”) govern your access to and use of the Party Destination Grid website, OpenSimulator virtual world, accounts, virtual currency, regions, events, Premium memberships, server services and related services.
By creating an account or using Party Destination Grid, you agree to these Terms.
1. Eligibility
You must meet the minimum legal age required in your country to use Party Destination Grid.
If applicable law requires parental or guardian consent, you may use the service only with that consent.
You must provide accurate information when registering an account.
2. Your Account
You are responsible for maintaining the security of your account, avatar and password.
You must not:
- share your password with unauthorized persons;
- attempt to access another user's account;
- impersonate another person;
- use another person's account without permission;
- attempt to bypass account or security restrictions.
You are responsible for activity performed through your account unless prohibited by applicable law.
3. Avatar Names and Profiles
Avatar names, profile descriptions, images and other public profile information must comply with these Terms.
Names or profiles designed to impersonate other users, organizations or administrators may be removed or changed.
4. Community Conduct
Party Destination Grid is intended to be a social and creative virtual environment.
Users must not use the service for unlawful activity, harassment, credible threats, fraud, malicious disruption, unauthorized access to systems, distribution of malware, or other activity that materially harms the grid or its users.
Users must respect the maturity rating and rules of individual regions and events.
5. Content
Users may create or upload content including virtual objects, textures, scripts, images, event descriptions and profile information.
You retain any rights you have in content you create.
By uploading content to Party Destination Grid, you grant us the limited rights technically necessary to host, store, transmit, display and process that content for operation of the service.
You must have the necessary rights or permission to upload content.
6. Intellectual Property
You must not upload or distribute content that unlawfully infringes another person's copyright, trademark or other intellectual property rights.
Party Destination Grid may remove content where reasonably necessary following a valid infringement complaint or applicable legal requirement.
7. Regions and Virtual Land
Party Destination Grid may offer virtual regions or land-related services.
Purchasing a virtual region does not constitute the purchase of physical real estate.
A region purchase provides access to virtual hosting or related services according to the package purchased.
Region availability, technical specifications and included resources may depend on the selected package.
8. Prim Packages
Users may purchase additional primitive (“prim”) capacity for eligible regions.
Prim packages are virtual service upgrades and have no independent physical-world ownership value.
Additional capacity applies according to the specifications displayed when the package is purchased.
9. Server Packages
Party Destination Grid may offer server or hosting-related packages.
Resources, limitations, duration and technical specifications are determined by the package selected at the time of purchase.
Users must not use server resources for unlawful activity, attacks, malware, unauthorized cryptocurrency mining, or activities that materially interfere with the infrastructure or other users.
10. Premium Membership
Premium membership may provide additional features or benefits.
Available benefits may change as Party Destination Grid develops.
Where Premium is offered as a subscription, it may continue until cancelled according to the terms displayed during purchase and the payment provider's subscription settings.
11. Payments
Prices are displayed before purchase and may be available in supported currencies such as USD, EUR or GBP.
Payments may be processed through third-party providers such as PayPal.
By purchasing a service, you authorize the applicable payment provider to process the transaction.
You are responsible for providing valid payment information.
12. Subscriptions and Renewals
Some services, including regions, server packages or Premium memberships, may operate as recurring subscriptions.
Where recurring billing applies, this will be indicated during checkout.
You are responsible for cancelling an unwanted subscription before its next renewal date.
Cancellation generally prevents future renewals but does not automatically refund previously completed billing periods.
13. Refunds
Because many Party Destination Grid products are digital services that may be provisioned immediately, refund eligibility may depend on the type of purchase, whether the service has already been activated, and applicable consumer law.
Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.
Users experiencing a billing or provisioning problem should contact Party Destination Grid support.
14. Virtual Currency
Party Destination Grid may operate an internal virtual currency.
Virtual currency is intended primarily for use within Party Destination Grid.
Unless explicitly stated otherwise, virtual currency:
- is not legal tender;
- is not a bank deposit;
- does not represent ownership in Party Destination Grid;
- does not generate interest;
- has no guaranteed real-world monetary value.
Party Destination Grid may investigate and correct balances affected by technical errors, unauthorized transactions, exploits or fraud.
15. Events
Users may create and publish events where this feature is available.
Event organizers are responsible for the accuracy of event information and must select an appropriate maturity rating, such as PG, Mature or Adult, where applicable.
Events must comply with the rules of the region in which they are hosted.
16. Mature and Adult Content
Some areas of Party Destination Grid may contain Mature or Adult-rated content.
Users must comply with applicable age restrictions and maturity settings.
Adult content must remain within areas where such content is permitted and appropriately rated.
17. Third-Party Services
Party Destination Grid may integrate with third-party services such as payment providers, viewers, external websites or infrastructure providers.
Those services may have their own terms and privacy policies.
Party Destination Grid is not responsible for third-party services outside our control.
18. Service Availability
We aim to keep Party Destination Grid available and reliable, but continuous or uninterrupted operation cannot be guaranteed.
Services may temporarily become unavailable because of maintenance, updates, hardware failures, network problems, security incidents or circumstances beyond our reasonable control.
19. Changes to the Service
Party Destination Grid is an evolving virtual world.
We may add, modify or discontinue features where reasonably necessary for technical, security, operational or business reasons.
Where a material change affects a paid ongoing service, we will seek to provide appropriate notice where reasonably possible.
20. Suspension and Termination
Accounts may be restricted or suspended when reasonably necessary because of serious or repeated violations of these Terms, fraud, security threats, unlawful activity or abuse of the service.
For serious violations, access may be terminated.
Where appropriate, users may contact support regarding an account restriction.
21. Abuse and Exploits
Users must not intentionally exploit bugs, vulnerabilities or technical errors to obtain unauthorized virtual currency, services, permissions, resources or access.
Security vulnerabilities should be reported privately to Party Destination Grid rather than publicly exploited.
22. Disclaimer
Party Destination Grid is provided on an “as available” basis to the extent permitted by applicable law.
We do not guarantee that the service will always be uninterrupted, error-free or compatible with every viewer, device, operating system or third-party service.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
23. Limitation of Liability
To the maximum extent permitted by applicable law, Party Destination Grid will not be liable for indirect, incidental or consequential losses arising from use of the service.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
24. Changes to These Terms
These Terms may be updated when Party Destination Grid introduces new services, changes existing functionality or when legal or security requirements change.
The current version will be published on the Party Destination Grid website.
Continued use following an effective update constitutes acceptance where permitted by applicable law.
25. Governing Law
These Terms are governed by the laws applicable to the operator of Party Destination Grid, subject to any mandatory consumer protections that apply in the user's country of residence.
